About the Encroachment Permit

You can obtain an encroachment permit application at the Department of Public Works/Engineering Division, 110 South Pine Street, Suite 221. You can also discuss your projects with the Engineering staff to get more information about appropriate work in the Public Right-of-Way.  You may also reach Engineering staff by calling (805) 925-0951 ext. 2225, or by sending an email to Engineering staff at pw_encroachment_permits@cityofsantamaria.org. Encroachment permit applications may be submitted in-person or via email at the pw_encroachment_permits@cityofsantamaria.org address.

An encroachment permit is an authorization to work in the Public Right-of-Way. This is usually a portion of public easement that runs on your property parallel to the street and several feet wide adjacent to the curb. It might also include utility easements noted on the title report for your property. Usually the public sidewalk, parkway, and driveway curb ramp to your property lie within these rights of way. If you want to work in those areas, the City has adopted rules or "standards" for the kind of improvements which can be permitted in those areas.

About the Erosion and Sediment Control Plan (ESCP)

When constructing an Accessory Dwelling Unit (ADU), you must comply with local and state regulations concerning erosion and sediment control. The City of Santa Maria enforces the minimum standards found in various model codes adopted by the State of California, including the California Building Code and the California Green Building Code. These codes mandate measures to prevent soil erosion and manage sediment runoff during construction. An Erosion and Sediment Control Plan (ESCP) is a document that outlines the measures to prevent soil erosion and manage sediment runoff during and after construction. It is designed to protect water quality by preventing sediment, debris, and pollutants from entering storm drains, waterways, and adjacent properties.

You can find the ESCP application at the link below. Once completed, submit it in person at the Engineering Division, located at 110 South Pine Street, Suite 221, or via email at pw_encroachment_permits@cityofsantamaria.org. Once all proper documentation is submitted, an Engineering Technician will contact you via the email provided in your application within 10 business days to notify you when the ESCP permit is ready for payment. If you have any questions, you may reach Engineering staff by calling (805) 925-0951 ext. 2225, or by sending an email to Engineering staff at pw_encroachment_permits@cityofsantamaria.org.
